Terms of sales

1. Preamble

These conditions are concluded between, on the one hand, Eggster, registered with the carrefour of enterprises bank under number 0685 910 061 and whose registered office is located Rue René Dubois 84/2 in 4500 Huy, hereinafter referred to as “Eggster”, and, on the other hand, the individuals wishing to make a purchase via the https://eggster.eu website hereinafter referred to as “the customer”.

2. Scope

These terms apply to any sale of products presented on the site https://eggster.eu. Any order placed on https://eggster.eu necessarily implies the confirmation of these terms of sales and thus implies their acceptance without reserve.

3. Stocks

The stock status mentioned on the site https://eggster.eu is for information only, update is done in real time, however it is possible that two customers order the last item of a series at the same time. Under these conditions Eggster undertakes to suggest a new delivery time depending on the printing time to one of the two customers in the event that the item ordered has to be reissued. In the event that the item is not to be reissued, Eggster undertakes to make a refund in the form of a voucher or to cancel the order and reimburse the customer as soon as possible.

4. Delivery and deadlines

All goods and services are delivered to the address you specify when ordering. In the event that the address you have given is incorrect, it will be your responsibility and may result in additional charges.

The products sold on Eggster are handmade and require a lot of time. The delivery time of our products is variable and depends on many factors (number of requests, stock status, location of the customer, etc.).

The average delivery time is one week (and a maximum of 2 weeks). If the delay exceeds the maximum delivery time (40 days), please contact our customer service.

5. Contract confirmation

The sales contract is deemed concluded only once the customer’s account has been debited for payments by credit card and ordinary bank card.

6. Ordering

To purchase a product, simply click on the “place order” button. To place an order, simply enter the desired quantity of products and click the “add to cart” button. Your order will automatically be added to your shopping cart; you can then continue shopping and do the same for other models. For each selected model, the cart fills up in the “cart” menu located in the navigation bar at the top right of your screen. Once the cart is full, you still have to place an order by clicking on “confirm the order”. Placing an order implies that the customer provides their exact delivery and billing addresses, checks the exact amount that will be billed, including the price including all taxes on each article as well as the price including all taxes of the shipping costs, selects the payment method and clicks on “Order”. Upon receipt of his order, the customer receives a package containing the item(s) ordered.

7. Secure payment

Online payment of products by credit card is made through Stripe. The data recorded by the Stripe payment system constitutes proof of the financial transactions carried out by credit card. Stripe does not transmit information relating to payment by credit card except, if necessary, in the event of a duly expressed complaint relating to a particular transaction. The customer declares having all the necessary authorizations for a payment by credit or debit card at the time of the confirmation of their order. In the event of suspicion of fraud, Eggster reserves the right to initiate a procedure to provide additional information to a customer by requesting various proofs and, following this procedure, to cancel or suspend any order or delivery, even in the event of payment authorization issued by Stripe.

8. Right to retract reserved for individuals

Under the conditions provided by law and in the context of distance selling, the buyer has a withdrawal period of 14 clear days from the delivery of their order which will be refunded against return of the products delivered. The buyer must return the goods in their original condition. The return of goods is at the customer’s own risk. The procedure to be followed for the return of goods will be detailed in the order confirmation email sent to the customer. We advise the customer to keep the proof validated by the postal service used, that the goods have been collected and returned to Eggster until Eggster receives the return package. The costs of returning goods are borne by the customer for all orders.

It is also always possible to retract by returning a retraction form such as the one shown below:

9. Law on the protection of privacy with regard to the processing of personal data

In accordance with the law relating to the protection of privacy with regard to the processing of personal data, the customer has the right to access and rectify data related to them. Eggster guarantees the customer full respect of the confidential information stored on the computer media. Eggster undertakes not to disclose any information that may enable third parties to know confidential data as provided by the law on privacy protection with regard to the processing of personal data.

10. Belgian Law, Litigation and Jurisdiction

In the event of a litigation, only the Courts of the judicial district of Huy ruling according to Belgian law will be competent. However, there is a European Commission online alternative litigation resolution platform: http://ec.europa.eu/odr. This platform was set up by the European Commission and is intended for consumers and professionals conducting online transactions in the European Union with the aim of facilitating alternative litigation resolution.
